Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and NEBULONS AI and govern your access to and use of the NEBULONS AI Studio platform and related services (the "Services"). By creating an account, executing an order form that references these Terms, or using the Services, you accept these Terms on behalf of the business you represent and confirm that you have authority to bind that business.

The Services are provided to businesses and professionals for lawful commercial use. You must provide accurate registration information, safeguard your account credentials, and be responsible for all activity that occurs under your account. You must promptly notify NEBULONS AI of any unauthorised access or use of your account.

You may use the Services only in compliance with these Terms and the Acceptable Use Policy. You are solely responsible for the data you submit, the instructions you configure, the models you train, and the outputs you deploy. You confirm that you have all rights, permissions, and lawful bases required to submit your data to the Services and to direct the processing you configure.

NEBULONS AI applies a zero-retention, no-training model to your data. Your data is processed only to execute your instructions, is never used to train or improve any model belonging to NEBULONS AI or any third party, and is permanently deleted when your instruction completes or when you request deletion. Full details are set out in the Data Retention and Deletion Policy, the Zero Data Retention & No-Training Commitment, and the Data Processing Agreement, each of which is incorporated into these Terms.

You retain all right, title, and interest in your data and in the models you fine-tune through the Services. NEBULONS AI retains all right, title, and interest in the platform, its foundation models, and its tooling. You receive a limited, revocable, non-exclusive licence to use the Services for your internal business purposes during the term of your subscription.

The Services are provided "as is" except as expressly warranted in the Service Level Agreement applicable to your plan. Except where prohibited by law, NEBULONS AI disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, NEBULONS AI's aggregate liability is limited to the fees you paid in the twelve (12) months preceding the claim, and neither party is liable for indirect or consequential damages.

You may stop using the Services and terminate at any time in accordance with your order form. NEBULONS AI may suspend or terminate the Services for material breach of these Terms or the Acceptable Use Policy, subject to notice where practicable. Upon termination, your remaining data is permanently deleted as described in the Data Retention and Deletion Policy.

NEBULONS AI may update these Terms to reflect changes in the Services or the law. Material changes will be notified in advance through the platform or by email and take effect on the stated date; continued use after that date constitutes acceptance. These Terms are governed by the law stated in your order form, and the courts or arbitration forum stated there have exclusive jurisdiction over disputes.
